JUDGMENT / ORDER

JUDGMENT G.P. Srivastva, J.
1. Heard learned Counsel for the appellant and learned A.G.A.
2. This is an application for bail on behalf of appellant Naunihal Singh Earlier the prayer for bail of appellant No. 2 Naunihal Singh was rejected by this Court on A merit vide order dated 20.12.2005. Subsequently on the application of the appellant the order was recalled because the records of the case were not summoned. The appellant Sobran Singh the husband of the deceased Smt. Rani Devi who was married 4 ½ years before her death. It has come in the evidence that there was 90% ante mortem bum on the dead body of the deceased. Smell of Kerosene Oil was coming from the hairs of the deceased. Documentary evidence in the shape of Inland letters written by the appellant were produced which go to show that the appellant was demanding gold chain, wrist watch, Almirah and buffalo in dowry. He was also threatening the deceased and refused to call her back from the house of her parents. There is a letter issued from Registrar of Military Hospital, Mathura showing that no dying declaration of the deceased was recorded during the treatment by any person. It has also come in the evidence that the appellant did not inform the parents of the deceased and cremated her.
3. In the circumstances I am of the opinion that the appellant Naunihal Singh does not deserve bail. The bail application is rejected.
