The petitioner herein seeks for quashing of the FIR dated 09.06.2021 registered as Case Crime No.252 of 2021 under Sections 323, 354, 354(B), 504, 506, I.P.C. & 3(2)(va) of SC/ST Act P.S Kharkhauda, District-Meerut.
The contention of the learned counsel for the petitioner is that the petitioner herein has been falsely implicated on account of dispute between the co-accused Ankit and the first informant over the Nali as they are living in the same mohalla.
A categorical statement in this regard has been made in the writ petition.
Looking to the allegations in First Information Report though we do not find any reason to quash the First Information but, it is provided that the petitioner shall not be arrested till the submission of the police report under Section 173(2) Cr.P.C. However, he shall cooperate in the investigation and shall not make any effort to influence any witnesses or tamper any evidence.
The writ petition is, accordingly, disposed of.
