The petitioner claims the benefit of the judgment in W.P(C) No.5205/2014, wherein this Court had declared that as per the extent regulations any M.Tech Student who qualifies in the End Semester Examination (ESE) with a passing grade in individual subjects shall be considered to have passed in the semester, without looking at the Semester Gross Percentage Average (SGPA). The petitioner is said to have passed in the first semester examination. If the petitioner has filed application within time and also remitted the fee, the petitioner shall be permitted to appear for the 4th semester viva voce examination, provided the petitioner has qualified in the 1st semester, as indicated above. Writ petition allowed.
