JUDGMENT / ORDER

The petitioner herein is the defacto complainant in crime No. 189/2014 of Njarakkal Police Station. He brought this writ petition under Article 226 of the Constitution of India for a writ of mandamus directing the first respondent to hand over investigation in the said crime to the third respondent. As an interim arrangement, this court made a direction on 24.9.2014 to the third respondent (Deputy Superintendent of Police, Aluva) to supervise the investigation being conducted by the 4th respondent, and also to enquire into the allegations made by the petitioner regarding the vicious and unholy involvement of somebody from the office of the Circle Inspector in the matter of investigation. Now the Deputy Superintendent of Police, Aluva has submitted report that he has taken over supervision of the investigation as ordered by the District Police Chief, Ernakulam Rural, and that he is definite that there is no sort of interference or intervention by anybody from the office of the Circle Inspector, or from any other office or source, in the matter of investigation. He has also reported that the W.P.(C)No.6565 of 2014 2 Investigating officer has already questioned the every material witnesses and has also arrested the accused involved in the crime. I am well satisfied that investigation now being conducted by the fourth respondent is on the right track, and it is definite that in view of the orders passed by the District Police Chief, the third respondent will effectively supervise and monitor the investigation being conducted by the fourth respondent. I find that the report submitted by the Deputy Superintendent of Police can be recorded, and the writ petition can be closed. In the result, the report submitted the Deputy Superintendent of Police, Aluva on 15.10.2014 is recorded, and this writ petition is closed with directions to the third respondent that investigation shall be properly and effectively monitored and supervised.
