Heard learned counsel for the petitioners, learned A.G.A. and perused the material placed on record.
Perusal of the F.I.R. discloses commission of cognizable offence. Therefore, it cannot be quashed.
However, it is submitted that initially a N.C.R. was registered under Section 323 I.P.C. only wherein no allegation in respect of Section 452 I.P.C. were made, as would be apparent from perusal of the F.I.R. It is said that otherwise also the offences are not so grave and are trivial in nature.
In view of the above mentioned facts and circumstances, this petition is disposed of with the direction that till any credible and cogent evidence is collected against the petitioners, (Sobha, Gyanu & Chhotu) they shall not be arrested in N.C.R. No. 152 of 2009, under Sections 323, 504, 506, 452 I.P.C. Police Station Saadatganj, District Lucknow, subject to their co-operation in the investigation which shall go on.
Petition is disposed of accordingly.
