(Per : HONOURABLE MR.JUSTICE P.B.MAJMUDAR) Learned counsel Mr.Shah for the appellant states that he may be permitted to withdraw the present appeal as the appellant would like to take out appropriate proceedings independently in accordance with law, if available in law.
Since learned counsel for the appellant seeks to withdraw the present appeal, without expressing any opinion on merits that whether the appeal is maintainable or not, permission as prayed for is granted. Accordingly the present appeal stands disposed of as withdrawn. However, it is clarified that if any proceedings are taken out by the appellant, concerned Court shall decide the said proceedings in accordance with law and on its own merits.
