JUDGMENT / ORDER

The petitioner has approached this Court with the following prayers:-
“i) issue a writ of mandamus or any other appropriate writ, order or direction, directing the 1st respondent to complete the staff fixation for the years, 2010-2011, 2011-2012 and 2012-2013 of M.M.H.S.S., Uppoodu managed by the 2nd respondent within a stipulated time;
ii) issue a writ of mandamus or any other appropriate writ, order or direction, directing the 2nd respondent to promote the petitioner to the post of H.S.S.T. (Senior) in Hindi language forthwith; and
iii) grant such other relief as this Hon'ble Court may deem fit and necessary in the facts and circumstances of the case.”
2. The learned counsel for the petitioner submits that, the petitioner is working as an H.S.S.T (Junior) Hindi in the 2nd respondent School and her appointment was approved as per Ext.P1. The staff fixation in the said School has been completed only up to 2009-2010. Since the said exercise has not been done in respect of the subsequent years, much adverse hardships are being caused to the petitioner, particularly in the field of W.P.C. No. 15778 2013 2 promotion. The representations preferred by the petitioner did not turn to be fruitful, which made the petitioner to approach this Court by filing this writ petition.
2. The writ petition was admitted as early as on 01.07.2013 and several adjournments were granted, directing the respondents to file Counter Affidavit, if any. The position remains as it is.
3. After hearing both the sides, this Court finds that the rights and liberties of the petitioner can be pursued further, only subject to finalisation of the staff fixation for the years 2010- 2011 and the subsequent years.
In the above circumstances, the 1st respondent is directed to complete the staff fixation for the years 2010-2011 onwards of the 2nd respondent School, in accordance with law and to consider the claim of the petitioner for promotion to the post of H.S.S.C. (Senior), Hindi. The above exercise shall be completed, at the earliest, at any rate, within 'three months' from the date of receipt of a copy of this judgment.
W.P.C. No. 15778 2013 3 Petitioner shall produce a copy of this judgment, along with a copy of the writ petition, before the 1st respondent, for further steps.
The writ petition is disposed of.
