JUDGMENT / ORDER

The 1st petitioner is a society registered under the Societies registration Act, 1860. The 2nd respondent claims to be its representative. They approached this Court on account of the non-disbursement of funds allotted under the Western Ghat Development Programme. It seems that there are disputes among members of the society and on account of this funds were not disbursed to the petitioner. The petitioner seeks the following reliefs : i) “Call for the records leading to Ext.P7 order and to issue a writ of mandamus or any other appropriate writ order or direction, directing the 4th respondent to release the amount Rs.16,00,000/- to the 2nd respondent as per Ext.P7 order to establish Sneha Rice, Flour and Oil mills at Kolarattukunnu, Veliyambam in Pulpally Grama Panchayat by the 1st peitioner Society.
ii) To issue a writ of mandamus or such other writs, order or direction, directing the respondents to implement Ext.P7 order and to do all necessary acts to set up Sneha Rice, W.P.(C).No.1339 of 2014 2 Flour and Oil Mill at Kolarattukunnu, Veliyambam in Pulpally Grama Panchayat by the 1st peitioner Society.”
2. It is admitted now that the fund has been released by the 4th respondent to the 2nd respondent. I am of the view that the eligibility of the society to have the fund is not disputed. The only question is regarding the dispute among the members. If the fund for which the society is entitled, to be disbursed to the society, not to any members. Therefore, the 2nd respondent who is now the custodian of the fund shall release the amount received from the 4th respondent in name of the Secretary of the society. Needful shall be done within a period of three months from the date of reciept of a copy of this judgment.
Writ petition is disposed of.
