1. Heard learned counsel for the petitioners, learned Standing Counsel appearing for the State-respondents and learned counsel appearing for Union of India.
2. By way of this petition, the petitioner prays for issuance of a writ, order or direction in the nature of mandamus directing respondent no.2 to take decision over claim/representation dated 15.02.2021, 1.3.2021 and 16.06.2021 in regard to releasing the amount of compensation/award in respect of Khasra no.3 (old No. 22/1), situated at village Futia, Tehsil and District Chandauli within stipulated time as fixed by this Hon'ble Court.
3. The prayers prayed by the petitioners are not as such which cannot be granted by this Court hence, granted.
4. This petition shall also form part of the representation which has already been made to the respondent No.2.
5. In view of above, we propose to direct respondent no.2-The Competent Authority/Sub Divisional Magistrate, Tehsil Sadar, District Chandauli to take decision in the matter, as prima-facie, at page-33 of the paper book, the amount has already been computed for the land of the petitioner acquired by the National Highway Authority of India. Now the petitioner counsel has requested that the authority competent in this regard may decide the claim of compensation of the petitioner and disburse the amount accordingly, therefore, instead of keeping the the matter pending, the authority competent shall dispose of the representation of the petitioners and if the petitioners are found eligible to get the compensation they shall be paid the same within a period of twelve weeks from today, if there is no legal impediment. In case of denial, it is open for the petitioners to revive this petition.
