S.Nalliakodan vs The Sub-Collector

Madras High Court|28 February, 2017

JUDGMENT / ORDER

K.K.SASIDHARAN,J.
The petitioner submitted application before the Sub-Collector, Tindivanam, to issue a Community Certificate, declaring the community status of his children. Since follow up action was not taken by the respondent, the petitioner is before this Court.
2. Heard the learned counsel for the petitioner and the learned Special Government Pleader on behalf of the respondent.
3. The petitioner submitted application for Community Certificate as early as on 6 May 2015. There is nothing on record to show that the respondent initiated action to dispose of the application.
4. We direct the respondent to consider and dispose of the application dated 6 May 2015 on merits and as per law. The application should be confined to the children of the petitioner. In case, the petitioner wanted Community Certificate for his grandchildren, necessarily, the application should be submitted by the father of the grandchildren. There is no question of submitting the application by the grandfather for issuing community certificate to his grandchildren. We therefore make it clear that the respondent shall consider the application submitted by the petitioner only in relation to his children and not in respect of grand children. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order.
5. The writ petition is disposed of with the above direction. No costs.
