S.Murugan vs The General Manager(Admn.)

Madras High Court|31 January, 2017

JUDGMENT / ORDER

The Petitioner seeks for a direction to the third respondent to make an enquiry as per the direction of the first respondent through his proceedings, dated 24.12.2016 and consequently for a direction to the first respondent to issue license for Local Cable Operation within the time stipulated by this Court.
2.Mr.M.Satheesh Kumar, learned Additional Government Pleader takes notice for the respondents 1 and 3.
3.By consent of both parties, the main Writ Petition is taken up for disposal, at the admission stage itself.
4.It is seen that the Petitioner was registered as a Cable Operator for running Cable Television Net-work under the Second Respondent, as evident from the proceedings of the Second respondent, dated 20.09.2016 issued in Form No.III. Consequently, the Petitioner approached the first respondent for issuing LCO Number to run the cable operation. It is seen that the first respondent in-turn has directed the third respondent to conduct an enquiry and file a report. Such communication sent by the first respondent on 24.12.2016 to the third respondent has not been acted upon so far. Therefore, the present Writ Petition is filed before this Court.
5.The learned counsel appearing for the respondents 1 and 3 submitted that an enquiry will be conducted and appropriate orders will be passed within the time stipulated by this Court.
6.Accordingly, this Writ Petition is disposed of, only with a direction to the third respondent to conduct an enquiry and sent a report to the first respondent, who in turn will pass appropriate orders on merits and in accordance with law. All these exercise shall be done by the respondents 1 and 3 within a period of six weeks from the date of receipt of a copy of this order. The Petitioner should furnish all the required documents/necessary fees to the first and third respondents, so as to enable them to pass appropriate orders as stated supra. No costs.
