Supplementary affidavit, second Supplementary affidavit and Rejoinder affidavit filed today are taken on record.
It is alleged that Smt. Alimun Nisha was being harassed and teased by the accused applicant mother in law and other family members on account of non fulfillment of the demand of dowry regarding motorcycle, gold chain and gold ring. The husband was working at other place outside the village and thus the deceased was living with the applicant and other family members. It has further been alleged that she committed suicide by sprinkling kerosene oil upon herself due to the harassment caused by the applicant and others.
The learned counsel for the applicant argued that the applicant is the mother in law of the deceased and was not having any connection with the demand of dowry. In fact the deceased was having illicit relation with her brother in law and when this affair came to the notice of various people, she committed suicide in self condemnation.
The learned A.G.A. on the other hand argued that it is a case where the husband was not living in the house and resided elsewhere and behind him the deceased was being harassed and teased for demand of dowry as a result of which she took the extreme step by committing suicide.
I considered over the respective arguments. Looking to the entire facts and circumstances of the case, I am satisfied that no case for bail is made out. The Bail application is accordingly rejected.
