JUDGMENT / ORDER

The plaintiff in O.S.No.298/2007 has preferred this appeal challenging the dismissal of the suit for partition.
2.Pending the appeal, the parties have entered into Compromise. A Memorandum of Compromise has also been filed and R.SUBRAMANIAN.,J.
KP the same has been signed by both the parties as well as the respective counsel appearing for the parties. The first respondent had died, and the second respondent is said to be a sole legal heir of the first respondent.
3.It is also stated that the husband of the appellant / son of the respondents 1 and 2, died in a road accident. The Compromise Memo is recorded and there shall be decree in terms of the said Compromise. The Memorandum of Compromise shall form part of the decree.
