Heard learned counsel for the petitioners and learned Additional Government Advocate.
Under challenge in the instant writ petition is FIR relating to Case Crime No. C-2957 of 2009, under Sections 323, 452, 324, 504, 506, 392 & 427 IPC, police station Kotwali City, district Sultanpur. We have gone through the contents of the FIR, which disclose commission of cognizable offence, as such, the same cannot be quashed. The writ petition is misconceived and is accordingly dismissed. However, it is provided that if petitioners No.1, namely, Smt. Maya Devi surrenders and moves application for bail, she being lady her bail application shall be considered and decided expeditiously by the courts below giving her benefit of Section 437 Cr.P.C.
So far as petitioner Nos. 2 & 3 are concerned, it is provided that if they surrender and move application for bail, the same shall be considered and decided expeditiously by the courts below. Order Date :- 8.1.2010 Pradeep/-
