JUDGMENT / ORDER

Heard learned counsel for applicant.
The grievance of the applicant is that the opposite party-contemnor has willfully and deliberately flouted the order of this Court dated 07.1.2014 passed in Second Appeal No. 01 of 2014, copy of which order has been filed as annexure-4 to the affidavit accompanying this application whereby the parties were directed to maintain status-quo with regard to possession and nature of the land.
When the matter was taken up on 05.11.2014, this Court had directed the learned counsel for the applicant to file supplementary affidavit annexing therewith the proof to show as to how the order of this Court was served upon the opposite party.
Today supplementary affidavit has been filed by the learned counsel for the applicant and in paragraph-4 thereof, it has been stated that the applicant had received counter affidavit in the aforesaid second appeal on behalf of the opposite party on 12.2.2014, therefore, the opposite party had full knowledge of the interim order passed by this Court but in spite of the same, sale deed has been executed by the opposite party on 23.5.2014, therefore, the opposite party has willfully committed the contempt of the order of this Court.
Issue notice to opposite party returnable within four weeks. Steps be taken within a week.
The opposite party may file counter affidavit within the aforesaid period. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
List after the expiry of the aforesaid period.
