Heard Sri Janardan Singh, learned counsel for the petitioners and Sri Alok Srivastava,appearing for opposite party no. 4. This Court on 24.12.2009 had directed the parties to appear before the Mediation and Conciliation Centre of this Court and deposit Rs.10,000/- and had stayed the arrest of the petitioners till the next date of listing or filing of the charge sheet, whichever is earlier. Neither as directed by this Court the amount of Rs.10,000/- has been deposited nor even steps were taken as per office report dated 13.1.2010 for getting service on opposite party no. 4 effected, although power on behalf of opposite party no. 4 has been filed by Sri Alok Srivastava Advocate.
Counter affidavit has been filed by the State, wherein in para 4 of the counter affidavit it has been stated that in case crime no. 631 of 2009 under Sections 498-A,323,504 I.P.C. and 3/4 Dowry Prohibition Act charge sheet has been filed being charge sheet no. 4 of 2009. Since the petitioners have not cared to comply with the order passed by this Court on 24.12.2009 and even charge sheet has been filed, as such this petition is dismissed for want of prosecution. Stay order stands vacated.
