Heard Sri Sudhir Kumar Singh, learned counsel for the petitioner and Sri Uttam Srivastava, learned Standing Counsel for the opposite party no.1.
This petition has been filed for a direction to the opposite party no.2 i.e. Principal Judge, Family court, Faizabad for disposal of the case No.628 of 1990 filed by the petitioner under Section 13 of the Hindu Marriage Act for divorce.
Copy of the order sheet indicates that on 04.03.2021, the notice has been deemed sufficient and thereafter the date was fixed on 23.04.2021 for written statement and issues, on which the general date was fixed for 05.07.2021. Before 05.07.2021, the petitioner had moved an application for exparte evidence. On 05.07.2021, the parties did not appeared so the date was fixed for 24.08.2021. However, learned counsel for the petitioner does not know as to what happened on 24.08.2021.
In view of above, since only two dates have been fixed after the service of notice has been deemed sufficient out of which on one date the petitioner herself has not appeared, this Court is not inclined to issue any direction at this stage as the petition is mis-conceived. It is accordingly dismissed.
However, the petitioner if so advised may move appropriate application before the concerned court for expeditious disposal, which may be considered by the concerned court.
