Heard learned counsel for the applicant and the learned A.G.A.
It is contended by learned counsel for the applicant that applicant is woman. She is not named in the FIR. It is alleged that from her possession 21 mobile phone have been recovered. In that recovery the applicant has been released on bail. The allegation against the applicant is that the mobile phone recovered from her possession can not be put up for identification. The applicant is in jail since 06.04.2012.
In view of the facts, circumstances of the case, submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Smt. Aanchal Babbar involved in case crime no. 52 of 2012 under Sections 392, 414 I.P.C., P.S. Talkatora, District Lucknow be released on bail on her furnishing a personal bond and two heavy sureties each in the like amount to the satisfaction of the Court concerned with the conditions:
1.that she will not temper with the evidence and
2.she shall report to the court of C.J.M. concerned in the first week of each month to show her good conduct and behaviour till conclusion of the trial.
