Heard learned counsel for the petitioner, Sri Sanjeev Kumar Pandey who has put in appearance on behalf of respondent no.3 and the learned AGA for the State-respondent.
Sri Sanjeev Kumar Pandey has raised objection that the present habeas corpus petition is not maintainable because earlier habeas corpus petition no.45228 of 2008 was filed by Akhilesh Kumar Kashyap (Gupta) and Smt. Vineeta Gupta wife of Akhilesh Kumar Kashyap, which was dismissed by this Court vide order dated 2.9.2008. It is thus contended that for the same matter now Smt. Vineet Gupta has filed the present habeas corpus petition, which is not maintainable.
On such objection being raised by respondent no.3, learned counsel for the petitioner states that he does not want to press the present petition. Accordingly, the present habeas corpus petition is dismissed as withdrawn. Order Date :- 22.1.2010 Hasnain
