Pursuant to the earlier order of this Court an affidavit of compliance has been filed duly sworn by Sri Manoj Kumar Giri, District Inspector of Schools, Ballia which is taken on record. Sri Santosh Kumar Singh, learned counsel for the petitioner states that actual payment has not yet been made to the applicant. Keeping in mind the details of the affidavit of compliance which has been filed today, two week's further time is granted to the District Inspector of Schools to ensure payment.
Sri Vashistha Tiwari, learned counsel for the District Inspector of Schools states with regard to payment of gratuity, G.P.F. and group insurance to applicant, papers have been forwarded to Director/Additional Director of Education (A-3)U.P. Education Directorate, Allahabad, Deputy Director of Education (Basic Educaion) Azamgarh Regional, Azamgarh and Senior Branch Manager, Samuhik Jeevan Bima Nigam, Allahabad for sanctioning and releasing the funds vide letters dated 16.4.2014, 21.4.2014, 23.4.2014, 18.12.2013 and 23.4.2014 which are still pending.
The husband of the applicant was the Principal of the Uchchatar Madhyamik Vidyalay, Neerupur, Ballia, who died in the year 2010. Since then the applicant has not been paid the post reiral dues of her husband. It is informed that the opposite party no.1 has been suspended and opposite party no.2 has been retired and some body is is working on officiating basis.
Taking note of that learned standing counsel is directed to get ensure the compliance of the order of this Court and file an affidavit of compliance of the District Inspector of Schools for releasing Rs. 232991.00 regarding arrears of salary which transpires from the letter dated 23.4.2014 written to the Additional Director of Education (A-3)U.P. Education Directorate, Allahabad, the amount of G.P.F. which transpires from letter dated 16.4.2014 written to the Deputy Director of Education (Basic Educaion) Azamgarh Regional, Azamgarh and the amount of insurance which transpires from letter dated 23.4.2014 written to the Senior Branch Manager, Samuhik Jeevan Bima Nigam, Allahabad.
The Director/Additional Director of Education (A-3)U.P. Education Directorate, Allahabad, Deputy Director of Education (Basic Educaion) Azamgarh Regional, Azamgarh and Senior Branch Manager, Samuhik Jeevan Bima Nigam, Allahabad are also directed to ensure complete necessary formalities and sanction the amount as prayed through letter of the District Inspector of Schools by 16th May, 2014.
List this case on 21st May, 2014. By that time, in case affidavit of compliance is not filed ensuring payment of all dues to the applicant, the Director/Additional Director of Education (A-3)U.P. Education Directorate, Allahabad, the Deputy Director of Education (Basic Education) Azamgarh Regional, Azamgarh and the District Inspector of Schols, Ballia shall remain present on the date fixed. Learned standing counsel is dircted to communicate this order to the Director/Additional Director of Education (A-3)U.P. Education Directorate, Allahabad, the Deputy Director of Education (Basic Educaion) Azamgarh Regional, Azamgarh within a week.
