Smt. Urmila Devi vs State Election Committee, U.P., ...

High Court Of Judicature at Allahabad|20 November, 2010

JUDGMENT / ORDER

Hon'ble Virendra Kumar Dixit,J.
Present writ petition filed under Article 226 of the Constitution of India challenging the outcome of the election seems to have been filed at premature stage. The outcome of the election can be impugned by the election petition as has been held by a Constitution Bench of Hon'ble Supreme Court in a case reported in AIR 1978 SC 851 Mohinder Singh Gill and another versus The Chief Election Commissioner, New Delhi and others. The petitioner has a statutory remedy to prefer an election petition before the prescribed authority.
The writ petition is not maintainable. It is accordingly dismissed at this stage with liberty to prefer an election petition.
