Learned counsel for the petitioner submitted that the petitioner is working as an Aaganwadi Karyakatri since 2004. On the complaint of present Gram Pradhan and his brother that the appointment of the petitioner is based on forged educational certificate, an inquiry proceeding has been initiated and accordingly the inquiry was made and after the inquiry report submitted by the Bal Vikas Pariyojna Adhikari, Ghaziabad, the District Magistrate vide order dated 31.5.2011 issued the direction permitting the petitioner to work as an Aaganwadi Karyakatri. In pursuance thereof, a letter dated 2.6.2011 has been issued by the Bal Vikas Pariyojna Adhikari, Ghaziabad, which is Annexure-11 to the writ petition, and in pursuance thereof, the petitioner is working on the said post. Now without giving any opportunity the Bal Vikas Pariyojna Adhikari, Ghaziabad has passed the impugned order dated 15.9.2011 cancelling the appointment of the petitioner on the ground that in the educational certificate some manipulation has been made.
Learned counsel for the petitioner submitted that once in inquiry, nothing adverse has been found and only because the Gram Pradhan, who is intending to remove the petitioner from the post of Aaganwadi Karyakatri, the impugned order has been passed.
The submission of the petitioner requires consideration.

Till the next date of listing, the operation of the order dated 15.9.2011 passed by the Bal Vikas Pariyojna Adhikari, Ghaziabad shall remain stayed.
