Learned counsel for the petitioners contends that despite an order of status quo and the respondents having been restrained from changing the nature of land by writ court vide interim order dated 18.01.2021, the respondents have proceeded to dig a foundation on the said piece land and the police authorities having been informed had failed to initiate any action till date.
Having heard learned counsel for the petitioner and having perused the records, what transpires is that the order of the writ court was for maintaining the status quo and restraining the respondents from changing the nature of the land in question. No report has been filed to indicate as to what was the nature of the land as on date of passing of the order and whether the foundation etc. has been dug before or after. Thus, disputed questions arise which cannot be seen while exercising contempt proceedings.
Taking into consideration the aforesaid, no notice is required to be issued to the respondents. The contempt petition is dismissed with liberty to the petitioners to avail other remedies that may be available to them before appropriate court in appropriate proceedings.
