JUDGMENT / ORDER

Heard learned counsel for the petitioner and the learned Standing Counsel for the respondent nos.1 to 5.
The case of the petitioner is that she being the seniormost LT grade teacher has been recommended for promotion on the post of Lecturer (Civics) by a Resolution of the Committee of Management and the papers have been forwarded to the District Inspector of Schools, Bulandshahar for being placed before the Regional Selection Committee headed by the Joint Director of Education, Meerut. It has been submitted that there are seven posts of Lecturer in the Institution and, therefore, four posts are to be filled by promotion under 50% quota whereas only two posts have been filled under the 50% promotion quota so far. It has been submitted that no decision has been taken so far on the proposal sent for promotion of the petitioner.
The learned Standing Counsel has submitted that this petition can be disposed of with a direction to the Joint Director of Education, Meerut Region, Meerut to place the proposal of the management before the Regional Selection Committee which can thereafter proceed in accordance with law.
Considering the facts of the case, this writ petition is therefore disposed of giving liberty to the petitioner to file a comprehensive representation before the Joint Director of Education, Meerut Region, Meerut (third respondent) in respect of her claim for promotion. If any such representation is filed with all the relevant documents and a certified copy of this order, the Joint Director of Education shall take an appropriate decision in the matter and if the papers are found in order, the same shall be placed before the Regional Selection Committee which will consider the case of the petitioner, in accordance with law, along with other eligible candidates and thereafter take appropriate decision in accordance with law. The aforesaid exercise should be completed within a period of eight weeks from the date of filing of such representation before the Joint Director of Education, Meerut Region, Meerut (third respondent). It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner.
