JUDGMENT / ORDER

Heard Sri Lalji Pandey, learned counsel for the petitioner and Sri V.K. Shukla, learned counsel for the respondents.
Learned counsel for the respondents points out that Kendriya Vidyalaya Sangathan, New Delhi has been notified under Section 19 of the Central Administrative Tribunals Act, 1985 and therefore, in view of the judgment of the Hon'ble Supreme Court of India in the case of L. Chandra Kumar versus Union of India & others reported in (1997) 3 SCC 261, petitioner must be asked to approach the Central Administrative Tribunal at the first instance.
In view of the aforesaid, the present writ petition is dismissed with liberty to the petitioner to approach the Central Administrative Tribunal under Section 19 of the Central Administrative Tribunal Act at the first instance.
