Smt. Sunita appeared in person along with her counsel. Step was taken to serve the respondent at the address of Sardar Patel Marg. It is informed that at present the respondent is Class IV employee in the District Court, Etawah and is residing there. Despite the notice being issued to serve the respondent by registered post, he has not put the appearance.
Let the appellant may take fresh steps to serve the respondent at the address of Etawah. We direct that the notice may also be served on Ram Babu through District Judge, Etawah. Necessary steps may also be taken in this regard.
It is informed that at present only a sum of Rs.1500/- per month is being paid by Ram Babu towards maintenance to her daughter, who at present is aged about 14 years and no maintenance is being paid to the appellant-wife. The appellant submitted that the amount of Rs.1500/- is insufficient to meet the expenses of herself and her daughter. The respondent being a regular Class IV employee of the District court must be getting more than Rs.20,000/- per month.
In view of the above, we are of the view that a reasonable amount should be given to the appellant to meet the expenses of her daughter and herself and for the future security of the daughter.
In view of the above, we direct that the respondent shall deposit a sum of Rs.5,000/- in fixed deposit per month in the name of Ms. Anjali and pay a sum of Rs.5,000/- further towards maintenance for her daughter and the appellant every month. We direct the District Judge, Etawah to deduct the aforesaid amount from the salary of the respondent and prepare a fixed deposit of Rs.5,000/- in the name of Ms. Anjali and remit a sum of Rs.5,000/- to the appellant at the time of payment of salary to Ram Babu every month. The appellant is directed to provide the bank account number to the District Judge, Etawah.
