Smt. Sunita vs Judicial Magistrate-Iiird, ...

High Court Of Judicature at Allahabad|04 February, 2010

JUDGMENT / ORDER

Heard the learned counsel for the petitioner and learned A.G.A. and perused the material on record.
It is said that on an application moved under Section 156 (3) Cr.P.C. vide order dated 01.09.2009 the learned lower court below treated it as a complaint case but till date the statements under Sections 200 and 202 Cr.P.C. have not been recorded despite specific request made to the court.
It appears to be an innocuous prayer.
Therefore this petition is finally disposed of with a direction to the court below to proceed with the matter expeditiously and record the statements under Section 200 and also under Section 202 Cr.P.C, if required, within three weeks, if possible, from the date a certified copy of the order is produced before it in accordance with law.
With these observations this petition is finally disposed of.
