Petitioners before this Court seek quashing of the first information report dated 03.09.2010, registered as Case Crime No. 1261 of 2010, under Sections 498A I.P.C. and 3/4 D.P. Act, Police Station-Barljera, District-Pilibhit.
Under order of the Court dated 12.10.2010 the matter was referred for mediation, being matrimonial in nature.
Counsel for the petitions states that the wife has not responded for mediation and therefore it has failed.
We have gone through the first information report. It does disclose a cognizable offence and therefore no case is made out for quashing of the first information report.
Writ petition is dismissed. Interim order, if any, stands discharged.
Learned A.G.A. shall forward a copy of this order to the S.P./S.S.P. concerned for the investigation being completed with due diligence, if not already completed.
At this stage counsel for the petitioners submits that since the wife has not responded for mediation, the money deposited by the petitioners in terms of the order of the High Court and payable to the wife may now be directed to be returned.
If the fact stated by the counsel for the petitioners are correct, they may make an application before the mediation centre within two weeks from today along with certified copy of this order, which shall take appropriate action within two weeks thereafter.
