Heard learned AGA for the State and perused the record.
This transfer application has been filed by the applicant Smt. Shrimati with a prayer that the proceedings of Case No. 56 of 2005 under Section 498-A, 323, 504, 506 I.P.C. and 3/4 D.P. Act, pending in the court of learned Judicial Magistrate, Mathura may be transferred to District Agra.
From the perusal of the record, it appears that there is no good grounds for transferring the case from District Agra to Mathura, such prayer is refused. The interim order dated 23.9.2005 is hereby vacated.
Accordingly, this transfer application is dismissed.
Let a copy of this order may be communicated to CJM, Agra to proceed further in above mentioned case in accordance with law.
