Counsel for the petitioner submits that the appeal was decided by Settlement Officer Consolidation on merit by order dated 20.10.2003. Tota Ram, respondent-1 filed an application for recalling the aforesaid order. In the recall application only allegation was made that the evidence on record filed by the applicant has not been considered. The petitioner filed an objection to the application stating therein that the appeal was decided on merit and recall application was not maintainable. However the Settlement Officer Consolidation by the order dated 18.1.2005 recalled the aforesaid order on the ground that basic year entry has been deleted without there being any cogent evidence. The revision filed by the petitioner has been dismissed.
The matter requires consideration.
Till the next date of listing, the operation of the orders dated 18.1.2005 and 28.3.2016 shall remain stayed.
