JUDGMENT / ORDER

(ORAL) Heard learned counsel for the petitioner.
This writ petition has been filed by the petitioner praying for a direction to be issued to the opposite party No.2 to decide the mutation case, said to be pending since March, 2018 before it, namely, Mutation Case No. T-201804040400762, Smt. Shakuntla Vs. Smt. Radhika Singh, at the earliest.
It has been submitted that as per rules, mutations, which are uncontested, ought to have been decided within 45 days and contested mutations, should and ought to have be decided within a period of 90 days.
The learned Standing Counsel has informed this Court that a perusal of the order sheet would show that repeatedly the advocates have failed to appear as they were abstaining from work.
This Court cannot issue any direction for decision of the case at the earliest, but looking to the facts, rules themselves provide a time limit for deciding the mutation cases, even if contested, it is provided that the opposite party No.2 may hear the parties in person, if needs be and pass appropriate orders, say, within three months from the date of production of certified copy of this order.
