The contention of the petitioner is that she is a teacher in Vikas Vidyalaya Ishwar Sharan Ashram, Allahabad. She has received a notice dated 24.7.2014, whereby she has been informed that she will retire from her service at the age of her superannuation i.e. 60 years on 31.8.2014. It is further contended that all the recognized institutions of the State Government has taken a decision regarding the age of superannuation of the teachers from 60 years to 62 years.
The petitioner has drawn the attention of the Court towards the order passed by this Court in WP No. 21808 of 2012; in respect of teachers of the aforesaid institution namely Vikash Vidyalaya Ishwar Sharan Ashram, Allahabad. In compliance of the said order, the District Social Welfare Officer, Allahabad has extended the age of superannuation of the teachers up to age of 62 years. He has also drawn attention of the Court to the final judgement passed by this Court in WP No. 12667 of 2007; Ram Narain Vs. State of UP and others and the the judgement passed in WP No. 21189 of 2005; B.L. Rakesh Vs. State of UP and others.
As far informations received by the learned counsel for the petitioner, no special appeal has been filed against the aforesaid judgements.
Learned standing counsel could not dispute the said fact.
As prayed by learned standing counsel, two weeks' time is granted to file counter affidavit. Rejoinder affidavit, if any, will be filed a week's thereafter.
In view of the aforesaid two judgments relied by the petitioner, the benefit is, therefore, extended to the petitioner that she will to continue as Assistant Teacher till the next date of listing.
