JUDGMENT / ORDER

Heard Sri Abdul Moin, learned counsel for the petitioner and Sri Birendra Prasad Singh for private respondents, who prays for and is granted only a week's time to file counter affidavit. He says that there will not be any default.
It is made made clear that in case the counter affidavit is not filed by the next date of listing, a cost of Rs. 5000/- shall be imposed.
Learned standing counsel has made categorical statement on behalf of commissioner that he had given notice to the petitioner before disbursing the amount in favour of private respondents.
Let the State produce the record of this case before this Court to see whether any notice was sent to the petitioner before disbursement of the amount.
