Learned counsel for the petitioners is permitted to implead the complainant Habib the father of corpus as respondent no.2 in the array of the parties.
It is submitted by the learned counsel for the petitioners that although the petitioner no.1 Smt. Sahidun is major and legally wedded wife of petitioner no.2, she is being illegally detained by respondent no.3 in Nariniketan, Gorakhpur, against her wishes and hence a writ of habeas corpus be issued directing the respondent no.3 to produce the corpus of the detenue Smt. Sahidun and set her liberty.
The submission made by learned counsel for the petitioners, prima facie, appears to be correct. The matter requires consideration.
Learned A.G.A. has accepted notice on behalf of respondent nos. 1 and 3.
Issue notice to respondent no.2 fixing 29.3.2016.
On that date, respondent no.2 Habib shall produce the corpus of Smt. Sahidun (detenue) before this Court.
List this matter on 29.3.2016.
