Heard learned counsel for the petitioner.
The petitioner has filed this petition for a direction upon upon Additional District Judge, Room No. 8, Allahabad to decide SCC No. 28 of 2009 (Safiya Qudeer vs. Mohd. Naeem Khan and others), pending before him within a stipulated period of time.
In view of Division Bench decision of this Court 2010 (1) ADJ 531 (DB) Km. Shobha Bose vs. Judge Small Causes Court no positive direction is possible.
However, it is left open to the petitioner to make appropriate application before the court concerned for its expeditious disposal and the court will consider it and try to dispose of the aforesaid case depending upon the pendency of the old cases before it by fixing short dates in quick succession, avoiding all unnecessary adjournments provided there is no legal impediment in doing so.
In case any adjournment is necessary, it shall not be granted otherwise than by imposing cost of atleast Rs. 500/-per adjournment.
The petition is disposed of.
