Sri Hemant Kumar Mishra, Advocate has argued that initially the F.I.R. was lodged for commission of offence under Sections 313/316, I.P.C. During investigation, no incriminating material was found. In the absence of any medical evidence, cancellation report was forwarded. A protest petition was filed, whereupon further investigation was ordered. Chargesheet has been filed for commission of offence under Section 15(3), Indian Medical Council Act, 1956 and Section 420 I.P.C. Learned counsel contends that the offence cannot be said to have been committed without any conclusive medical evidence.
Issue notice, returnable on 23.7.2012.
Further proceedings in the case shall remain stayed till the next date of listing.
