JUDGMENT / ORDER

The office report indicates that the notice has been served upon the opposite party is sufficient.
The opposite party is neither personally present nor is represented by counsel.
The present Transfer Application has been filed with the prayer to transfer the Misc. Case No. 1039 of 2015 (Kunal Vs. Smt. Ruchi), under Section 25 of Indian Guardianship and Wards Act read with Section 6 of Hindu Minority and Guardianship Act from the Court of Principal Judge, Family Court, Agra to the Court of Principal Judge, Family Court, Bulandshahar.
The proceedings under Section 125 of Cr.P.C. and 498-A of IPC are pending in Bulandshahar in which the opposite party is putting in appearance.
It is further stated that the applicant is living with her parents in Bulandshahar. She has no source of income and as to look after her son. It is difficult for her to need out the expenditure for travelling to Agra. No alimony has been awarded to her till date.
In view thereof, this Court finds it fit to transfer the Misc. Case No. 1039 of 2015 (Kunal Vs. Smt. Ruchi), under Section 25 of Indian Guardianship and Wards Act read with Section 6 of Hindu Minority and Guardianship Act from the Court of Principal Judge, Family Court, Agra to the Court of Principal Judge, Family Court, Bulandshahar.
The record be transmitted within one month.
