Heard learned counsel for the petitioner, learned A.G.A. and learned counsel for the opposite party Nos. 5 & 6.
In compliance of order dated 26.11.2015, detenue Smt. Roopali has been produced before the Court by opposite party Nos.5 & 6 (brother and mother). Detenue Smt. Roopali has been identified by the learned counsel for the petitioner and learned counsel for the opposite party Nos.5 & 6 and by the husband of detenue Smt. Roopali.
On being query made by the Court detenue Smt. Roopali states that her marriage was solemnized in the year 2014 with Dhirendra Kumar Maurya. She further states that the behaviour of her husband, Dhirendra Kumar Maurya is not good due to which she is living with her parents (opposite party Nos.4 & 6). She has further stated that she is not in illegal detention of opposite party Nos. 4 to 6 (Father, brother and mother). She is living with her parents on her own sweet will.
Admittedly, the detenue Roopali is major. Detenue Smt. Roopali has clearly stated that she is not in illegal detention of opposite party Nos.4 to 6 or anyone.
In view of the statement of detenue Smt. Roopali, this Hebeas Corpus Writ Petition fails and is accordingly dismissed.
