Heard learned counsel for the petitioner as well as learned A.G.A. for the State.
This petition under Article 226 of the Constitution of India has been filed for a writ of habeas corpus to produce the detenue Smt. Renu Chauhan, who is allegedly in illegal possession of her father through her husband Sunil Kumar.
Some photographs have been placed on record which shows garlanding each other by detenue and the said Sunil through whom this petition has been filed.
While the marriage certificate has been issued by some "Vavahk Sewa Samti" it is not known as to how the alleged society is competent to issue marriage certificate. There is no valid proof of marriage between the detenue and Sunil. This Court cannot entertain this kind of petition, therefore it is not maintainable and the same is dismissed.
