Heard learned counsel for the parties.
With the consent of learned Counsel for the parties, the writ petition is being disposed of finally at the admission stage itself.
Grievance of the petitioners is that without any acquisition or requisition under the Act, the opposite parties are raising construction of road and pullia over their agricultural land and as such, they preferred an representation dated 21.10.2008 to the Executive Engineer (Civil), Distribution Division, U.P. Power Corporation Ltd., Lucknow but no heed was paid.
Counsel for the petitioners submits that interest of justice would suffice, if the opposite party No.2- Executive Engineer (Civil), Distribution Division, U.P. Power Corporation Ltd., Lucknow is directed to decide the petitioners' representation dated 21.10.2008 contained in Annexure No.4 to the writ petition, expeditiously, to which learned Standing Counsel has no objection.
Considering the peculiar facts and circumstances of the case, we dispose of the writ petition with a direction to the opposite party No.2-Executive Engineer (Civil), Distribution Division, U.P. Power Corporation Ltd., Lucknow to look into the matter and pass appropriate order on the petitioners' representation dated 21.10.2008 contained in Annexure No.4 to the writ petition, in accordance with law, after affording opportunity of hearing to the petitioners, expeditiously, say, within a period of three months from the date of receipt a certified copy of this order and communicate the decision to the petitioners forthwith.
