Civil Misc. Impleadment Application No. Nil of 2010 is allowed is allowed. Let necessary incorporation be carried out during course of the day. Heard the learned counsel for the applicant. It is alleged that the order dated 12.12.2008 passed by this Court has been violated. From a perusal of the petition, a prima facie case is made out. Issue notice to the newly added opposite party no.2 fixing a date in the week commencing 22.2.2010. The newly added opposite party no.2 need not appear at this stage.
The counter affidavit may be filed within the aforesaid period or else charges may be framed after summoning the noticee. However, one more opportunity is granted to the opposite party no.2 to comply with the order within a month.
