By means of this application under Section 24 C.P.C., the applicant has prayed for trasnsfer of Petition No. 1076 of 2011 (Rajesh Kumar Vs. Smt. Reeta Saroj) filed under Section 9 of the Hindu Marriage Act, from the Court of Civil Judge (Senior Division), Ghaziabad to a competent court of District Kaushambi.
Learned counsel for the applicant submits that the petitioner has a child of 8 months and she along with her child is staying with her parents at Kaushambi. It is further submitted that the applicant is a poor lady and as such she is unable to contest the case at District Ghaziabad, which is about 600 Kms. from Kaushambi.
Issue notice to the opposite party returnable at an early date.
List the matter after service of notice.
In the meanwhile, the further proceeding in Petition No. 1076 of 2011 (Rajesh Kumar Vs. Smt. Reeta Saroj), pending in the Court of Civil Judge (Senior Division), Ghaziabad, shall remain stayed till the next date of listing.
