High Court Of Judicature at Allahabad|28 August, 2019

JUDGMENT / ORDER

Heard learned counsel for the petitioner and learned State counsel.
The petitioner by means of this petition challenges a notice dated 27.04.2018 issued to her under Section 67 of the U.P. Land Revenue Code, 2006 whereby she has been required to show cause as to why she may not be evicted from some area of plot no. 473 kha as the said land belongs to the Land Management Committee. The petitioner has also sought direction for disposal of the objection said to have been preferred by her which has been annexed as Annexure No.4 to the writ petition.
So far as challenge to the show cause notice is concerned, since the same cannot be said to be without jurisdiction, as such no interference in this writ petition is permissible.
As regards the prayer for expeditious disposal of the objection, it is directed that the authority/court concerned shall consider the said objection and any additional objection which may be filed by the petitioner within a fortnight from today and take appropriate decision in the matter as expeditiously as possible, say, within a period of three months from the date of production of certified copy of this order.
With the aforesaid observations/directions, the writ petition is finally disposed of.
