Heard learned counsel for the petitioners and learned Additional Government Advocate.
Under challenge in the instant writ petition is FIR relating to Case Crime No. 182 of 2010, under Section 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, police station Maholi, district Sitapur.
We have gone through the contents of the FIR as well as gang chart which forms basis of lodging of the present FIR. In the gang chart there is one case relating to Case Crime No. 1005 of 2009, under Sections 302/ 201/ 120-B IPC, police station Maholi, district Sitapur has been shown against the petitioner, as such, we do not find any merit to quash the impugned FIR.
The writ petition is misconceived and is accordingly dismissed. However, considering that the petitioner is a lady it is provided that if she surrenders and moves application for bail, the same shall be considered and decided expeditiously by the courts below. Order Date :- 21.6.2010 Pradeep/-
