Smt. Ram Devi vs The State Of U.P

High Court Of Judicature at Allahabad|29 February, 2012

JUDGMENT / ORDER

Heard learned counsel for the applicant, learned A.G.A. and perused the record.
Learned counsel for the applicant submitted that applicant is the mother-in-law of the deceased. The marriage of the deceased was solemnized about three years prior to the incident. There are general allegations of demand of dowry against all the accused but demand of dowry could not be established. The victim was admitted to the hospital by her husband but she could not survive. On autopsy, no ante mortem injury was found on the person of the deceased and cause of death could not be ascertained. Viscera was preserved but the viscera has not yet been received and charge-sheet has been filed without viscera report.
Learned A.G.A. opposed the prayer for bail.
In absence of viscera report, the death of the victim cannot be said to be unnatural.
Considering all the facts and circumstances of the case and without expressing any opinion on the merits of the case, I find it to be a fit case for bail.
Let the applicant Smt. Ram Devi involved in Case Crime No. 136 of 2011, under Section 306 IPC, P.S. Lonar, District-Hardoi be released on bail on her furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned with the following conditions:-
(a) The applicant shall attend the court according to the conditions of the bond executed by her;
(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
