The respondents are granted one month time to file counter affidavit. The petitioners will have three weeks thereafter to file rejoinder affidavit.

Counsel for the petitioner submits that petitioners were appointed with the approval of Basic Siksha Adhikari. Now one Member of Committee of Management has filed objection against appointment of the petitioners in which the inquiry is being conducted by the Assistant Director of Eduction (Basic), Meerut region, Meerut. Due to inquiry the Basic Siksha Adhikari has withheld the salary of the petitioners by the impugned order dated 13.5.2016. The submission of the counsel for the petitioners is that till today there is nothing adverse found against the petitioners as such salary of the petitioners cannot be withheld due to pendency of inquiry.
The matter requires consideration.
Till the next date of listing, the operation of the order dated 13.5.2016 shall remain stayed and the petitioners shall be paid salary from month to month.
