Heard learned counsel for the parties and perused the record.
Submission of learned counsel for the petitioner is that the deduction of amount to the extent of Rs. 50% is too excessive and would cause undue hardship to the petitioner, who is a widow of Late Ram Shanker Yadav.
Submission of petitioner's counsel carries weight to the extent that the deduction may be done in such manner that the petitioner may not suffer great hardship. Hence, deduction of 25% of the pension would suffice the purpose.
Accordingly, we dispose of the writ petition directing the respondents to consider the petitioner's case sympathetically to deduct only 25% of the monthly pension payable to the petitioner.
Subject to above, the writ petition stands disposed of.
