Heard learned counsel for the petitioner and Sri Rakesh Srivastava learned Standing Counsel for the opposite party no.1.
With the consent of learned counsel for the parties, this writ petition is being disposed of at the admission stage.
In view of the order, which is proposed to be passed notice to respondent no.2 is dispensed with.
Learned counsel for the petitioners submits that the petitioner has applied for mutation of the said land in their favour before opposite party no.1 under Section 34 of the L.R. Act in the year 2008 and since then the matter is pending at his end and has not been decided. A request has been made by the learned counsel for the petitioners that the matter regarding mutation pending before opposite party no.1 shall be decided at an early date.
In view of the facts as stated herein above and in the interest of justice, the opposite party no.1, is directed to consider and dispose of the matter pending before him regarding mutation in question expeditiously , say , within a period of six months from the date of receipts of a certified copy of this order after hearing the learned counsel for the parties in accordance with law.
With the above observations and directions, the writ petition is finally disposed of.
It is clarified that this Court has not adjudicated the claim of the petitioners on merit.
