Heard learned counsel for the applicant and learned A.G.A. for the State.
The grievance is that the applicant's husband was murdered and the FIR registered as case crime no.141 of 2010 under Section 302 IPC. The police submited final rpeort after completing investigation and the final report has been accepted without issuing notice to the first informant.
Issue notice to opposite party no.2 returnable at an early date.
Counter affidavit may be filed within three weeks. Rejoinder affidavit may be filed within three weeks thereafter.
List for admission immediately on expiry of the aforesaid period.
Till the next day of listing, the impugned order dated 16.4.2010 passed by the Chief Judicial Magistrate, Gautambudh Nagar in case crime no.141 of 2010 under Section 302 IPC of P.S. Sector 58, Noida, Distrit Gautambudh Nagar shall remain stayed.
