Both the parties appeared in person along with their counsel. We have interacted with both of them. The possibility of their amiable settlement has been explored. We are of the view that some more time may be allowed to settle their dispute amicably. The appellant is living separately with her two daughters, one aged about 14 years, studying in X Class and the second, aged about 12 years, studying in VIII Class. The respondent claims that he is living with his mother separately and he is working in RTGN as a Grade-II. The appellant contended that the gross salary of the respondent is about Rs.54,000/-. The net amount which he is receiving is less. We are of the view that the future of both the daughters is to be secured.
The appellant is working as Warden and is getting about Rs.10,000/-. It is informed that Rs.5200/- has been fixed towards maintenance for the wife and the children, which is being deducted from the salary directly. In the circumstances, we direct the BHEL authority to deduct a sum of Rs.25,000/- from the salary of Pratipal Singh every month and out of the said amount prepare a fixed deposit of Rs.10,000/- (ten thousand) each in the name of two daughters every month yielding maximum interest in Nationalized Bank which will only be utilized at the time of the marriage, such stipulation be made in fixed deposit itself and pay a sum of Rs.5,000/- cash to the appellant in each month. It is made clear that no further amount will be paid by the respondent to the appellant.
